General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fall, struck-by and crushed-by: ***Certification AND Documentation of Abatement Required*** a) The employer does not ensure that employees operating powered industrial trucks use seatbelts, exposing employees to the hazard of falling out of and being struck by the powered industrial truck. This violation was found to exist on or about 08/25/2010, where the forklift operator did not use a seatbelt while loading trucks at dock #1. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ITSDF/ANSI B56.1-2005, Section 5.1.4 which requires that all operators read and follow the manufacturer's operator manual and abide by the safety rules and practices. Pursuant to 29 CFR 1903.19(d), Immediately Upon Receipt of Citation, the employer must submit an abatement plan describing the actions it is taking to ensure that all industrial trucks are operated safely and with the use of seatbelts. This violation must be abated no longer than 10 days from receipt of this citation.
