Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about May 12, 2008, in the saw bay at the tsuni saw, an employee was allowed to work at heights greater than five feet in a cage supported by the forks of an industrial truck in order to open and close a valve located about ten and a half feet above the floor. The cage was not securely attached to the industrial truck and thereby the employee was exposed to a fall of about five feet to the ground. Among other methods, feasible and acceptable abatement methods include following the requirements for lifting personnel explained in the ANSI/ASME B56.1-2000 Safety Standard for Low and High Lift Trucks.
