Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and place of employment which were free from recognized
hazards that
were causing or likely to cause death or serious physical harm in that
employees were
exposed to the hazard of fire and explosions:
Dump Room/Building - On or about June 19, 2008, employees were not
adequately protected
against fire and explosion hazards in that:
a. Enclosures such as the screw conveyors, bucket elevator, and day bin,
that processed or
handled combustible granulated sugar, were not designed to minimize damage
if a fire or
exposion occurred, due to lack of fire and explosion prevention and
mitigation controls.
b. Receiving systems prior to the leg (bucket elevator) were not equipped
with devices to
minimize or eliminate tramp material from the product stream.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is to comply with National Fire Protection Agency
(NFPA) 61
"Prevention of Fires and Dust Explosions in Agricultural and Food
Processing Facilities"
(2008); NFPA 68 "Standard on Explosion Protection by Deflagration Venting"
(2007);
NFPA 69 "Standard on Explosion Prevention Systems" (2008), including, but
not limited to:
a) Install a deflagration detection and suppression system in accordance
with Chapter 8 of
NFPA 69.
b) Install devices and systems that vent combustion gases, materials and
pressures outside to
a safe location in accordance with NFPA 68.
c) In addition to, or in conjunction with, deflagration venting, isolate
equipment
interconnected by pipes and/or ducts using methods described in Chapter 9
of NFPA 69.
