Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the failure of the Star Industries Model 1208 Safety Work Platform: a)Construction site - Employees overloaded the Star Industries Model 1208 Safety Work Platform when riding it to and from the approximate 40' level Fraco Scaffold platform. Violation was observed on or about 11/30/07. One feasible and acceptable abatement method would be to use the safety work platform in accordance with the manufacturer's limitations that are outlined in the Safety Standards for Star Safety Work Platforms. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED AS PER 29 CFR 1903.19.
