29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: a) Northwest side of building: Employees working at two different levels on a fabricated frame mason's scaffold, were not using any head protection while working with their tools, moving or adjusting guard rails, on or about 09/18/2017; b) Northwest side of building: Employees working below and in the vicinity of the base of the fabricated frame mason's scaffold, were not using any type of head protection, on or about 09/18/2017. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(b)(4): Each end of a platform, not cleated or otherwise restrained by hooks or equivalent means, did not extend over the centerline of its support at least 6 inches (15 cm): a) Northwest side of building, west side of the platform, north end at the top working level: Employees were working from a 40 foot high fabricated frame mason's scaffold platform where two (2) scaffold planks extended over the centerline of its support approximately 2-3 inches for one of them and 4-6 inches for the other, on or about 09/18/2017. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) Haddonfield Middle School, north side between Haddonfield Schools Administration Offices and Middle School: Employees without proper fall protection were working from the scaffold platform approximately 40 feet above the ground on the fabricated frame mason's scaffold, on or about 09/18/2017. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19. DANDREA MASONRY, INC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD 29 CFR 1926.451(g)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1051973 CITATION NUMBER 1, ITEM NUMBER 3, AND WAS AFFIRMED AS A FINAL ORDER ON 10/15/2015, WITH RESPECT TO A WORKPLACE LOCATED IN THE VICINITY OF, 144 NJ 73, VOORHEES, NEW JERSEY 08043.
