Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the failure of the Model TH63 Caterpillar telehandler when
lifting a 12' x 12'
homemade personnel platform:
a)Construction site - Employees were using a Model TH63 Caterpillar
telehandler, PIN *5WM03400* for the support of a homemade 12' x 12'
personnel platform approximately 13' 2" above the ground. Violation
observed on or about 12/31/07.
One feasible and acceptable abatement method would be to use a scissor's
lift of an
appropriate size or the erection of fabricated frame scaffolding where
needed.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE
EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION
FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN
ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR
1903.19.
