North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rotating parts such as sprokets, chains and fan blades: a)hanging baskets machine area, unguarded chain about 4 feet from the floor without a guard. b)downstairs barn, flat filler machine, employees were using a flat filler machine with the chain and sprocket missing a guard. c)maintenance area, fan blades were not guarded, openings were greater than 4 inches.
