Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while exposed to fall hazards: (a)At the Shopko jobsite; employees were exposed to fall hazards, approximately 28'-u" above the ground, when using the midrail and toprail of a SkyJack scissor lift to gain access to the roof. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as maintain a firm footing on the platform floor as outlined in American National Standard for Self-Propelled Elevating Work Platforms ANSI/SIA A92.6-1999, Section 7.10(9). Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
