Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of potentially being ejected from TUG vehicles in the event of a vehicular accident: (a)Workers operating various TUG vehicles (eg., towing tractors, push back, belt loader) in the Ramp Area were exposed to the hazard of potentially being ejected from the vehicle in the event of a vehicular accident. Although the manufacturer equipped the TUG vehicles with safety belts and specified that the seat belts are to be used when operating the TUG vehicles, seat belts were not being used by workers while operating these vehicles. A feasible abatement method to correct this hazard is for the employer to ensure that workers wear the provided seat belts while operating these vehicles. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
