OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while operating TUGs. (a) At the General Mitchell International Airport in Milwaukee, Wisconsin, various ground service equipment, such as but not limited to the TUG baggage tow tractors, belt loaders, snow plows, and aircraft push-back tractors, were operated without the use of passive restraint devices (seat belts). Employees were exposed to struck-by hazards from operating these vehicles out in the elements while traveling around corners, on ramps, or on surfaces covered with snow and/or ice while carrying baggage or pushing snow. AIR WISCONSIN AIRLINES CORPORATION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD [OSH ACT OF 1970 SECTION 5(a)(1)], WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311402051, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 25, 2009, WITH RESPECT TO A WORKPLACE LOCATED AT 5300 SOUTH HOWELL AVENUE, MILWAUKEE, WISCONSIN 53207.
