Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by the backhoe's bucket:
(a)At the site, rebar, instead of the pins that meet the manufacturer's
specifications, were
used to secure a bucket to a Case 580 Backhoe.
Among other methods, one feasible and acceptable method to correct this
hazards is to:
1.Follow the Association of Equipment Manufacturers (AEM) "Safety Manual
for
Operating and Maintenance Personnel" that required damaged and missing
parts
to be repaired or replaced.
2.Follow the manufacturer's operator manual by using only service parts
that meet
the manufacturer's specifications.
3.Train operators and maintenance personnel to complete service and
repairs
before
equipment is placed back in service.
