Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of being struck by: (a)Gulf Coast Pre-Stress, Inc. fails to ensure that employees are not exposed to struck by hazard. This practice of failing to remove cranes from service with deficiencies that constituted a safety hazard was most recently observed at a worksite located at 494 North Market Street, Pass Christian, MS during the period May 24, 2007 through February 7, 2008 with employees in the pre-stress yard being exposed to struck by hazards created by cranes operating with hydraulic leaks, no brakes, cracked structures, missing cotter pins from shackles and damaged spreader bar. The deficiencies were observed on Mi-Jack cranes No. 2 and No. 7. To abate this hazard Gulf Coast Pre-Stress, Inc. must ensure that all cranes with deficiencies that create a safety hazard are removed from service until repairs are completed. Date by which violation must be abated: Immediately upon receipt of the Citation and Notification of Penalty. Pursuant to 29 CFR 1903.19, Gulf Coast Pre-Stress, Inc. within 10 days of receipt of this Citation and Notification of Penalty, must submit documents describing the steps it is taking to ensure compliance including a description of how the employer will ensure that complete repairs are made.

This practice of failing to conduct monthly crane inspections by designated person(s) was most recently observed at a worksite located at 494 North Market Street, Pass Christian, MS during the period December 27, 2007 through January 28, 2008 which exposed employees in the pre-stress yard to struck by hazards created by not conducting monthly inspections on Mi-Jack crane no. 7. Mi-Jack crane no. 7 was operated with deficiencies that created a safety hazard. To abate this hazard Gulf Coast Pre-Stress, Inc. must ensure that monthly crane inspections are conducted on all cranes. Date by which violation must be abated: Immediately upon receipt of the Citation and Notification of Penalty. Pursuant to 29 CFR 1903.19, Gulf Coast Pre-Stress, Inc. within 10 days of receipt of this Citation and Notification of Penalty, must submit documents describing the steps it is taking to ensure compliance including a description of how the employer will ensure that complete repairs are made.
