29 CFR 5(a)(1):  of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees are exposed to struck-by hazards caused by
moving vehicles.
This hazard was most recently observed near Scribner & Reynolds St.
Intersection, Endicott,
NE  68350. An employee sustained fatal injuries when the tanker rolled
back approximately
70 feet down an incline and crushed the employee between the company
tractor and another
contractor's tanker.
Among other methods, feasible and acceptable methods of abatement are:
1. Develop and document a training program that includes re-training of
drivers
identified as failing to follow safety protocols through inspections,
near-misses,
accidents etc.
2. Develop and document inspection and/or safety enforcement protocols to
help
identify drivers who could benefit from re-training, i.e. fail to follow
safety protocols.
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful.  The
abatement certification sheet is enclosed with the citations.
