Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard. a) Center house on 4 Bergen Street, Harrison, NJ. An employee stood on both midrail and toprail to climb out of the Scissor Lift basket in order to reach an area where he needed to perform his work. He was exposed to a fall hazard of approximately 15 feet to the ground below. Among other method's, one feasible and acceptable abatement method to correct this hazard is to comply with ANSI A 92.6-1999, Self Propelled Elevating Work Platforms, Section 7.10, paragraph 9 which states: "Personnel footing. Personnel shall maintain a firm footing on the platform floor while working thereon. Climbing by occupants on the midrail or toprail of the aerial lift is prohibited. The use of planks, ladders or any other devices on the platform for achieving additional height or reach is prohibited". Violation observed on or about 11/3/2007.
