5(a)(1): Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees were exposed to the hazard of vessel failure resulting from over-pressurization in the three pressure pots used in the pneumatic conveying system. Vessel failure could cause employees to be struck by shrapnel from an explosion or cause injuries from building structural damage. No safety relief valves were installed on these vessels which will serve to vent any excess pressure and prevent vessel failures. Among other abatement methods, one feasible and acceptable method is to install safety relief valves on the vessels in accordance with National Fire Protection Association (NFPA) 61, Standard for Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities, Section 11.3.3 and ASME International, 2007 ASME Boiler & Pressure Vessel Code, VII, Division 1, rules for Construction of Pressure Vessels, section UG-125 General.
