Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and run-over hazards: On November 1, 2007, at the site located at the NE corner of Route 173 and Green Bay Road (CVS Store) in Zion, Illinois, an employee of Berger Excavating Contractors, Inc. was observed riding on the rear bumper of the company's pick up truck that was driven by another employee. The employee was exposed to falling off of the rear bumper of the truck onto to the pavement and being run-over by the trailer that was attached to the driven truck. Among other feasible and acceptable methods to correct this hazard, employees should: a) ride within the cab of the truck with a closed door and fastened seat belt or b) walk to the sections of parking lot; in which punch less work was going to be performed. **In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).**
