Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown off and struck-by a forklift truck: (a)On March 18, 2009, and at times prior thereto, employees were exposed to a struck by hazard when operating Toyota fork lift trucks when loading and unloading trucks, without using the provided and functional seatbelt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure thatemployees follow the manufacturers operating instructions to always wear the seat belt and ensure the forklift is equipped with the appropriate restraint device, system, or enclosure as required by section 7.41 of ITSDF B56.1-2005. Note: Abatement certification IS NOT required for this item.
