Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Employees were exposed to being struck by falling or shifting loads in that the home-made "C" hook(s) and the rebar lifting device(s) (spreader bars) and their components were not designed and rated to determine their ability to withstand the stresses applied and to ensure that load attachment means allowed for proper distribution of the load and were not subject to displacement. One feasible means of abatement would be to comply with requiements for construction, marking, operation, maintenece and inspection of Structural and Mechanical Lifting Devices, Chapter 20-1, of ANSI B30.20-2003, "Below The Hook Lifting Devices".03,
