Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries in the event of an accident / equipment roll over and the provided seat belt was not utilized: (a)Adjacent to Rt. 19 & Division Run Road: The provided seat belt was not worn by the operator of the Cat 315 C excavator as determined on 8-12-09. (b)Adjacent to Rt. 19 & Division Run Road: The provided seat belt was not worn by the operator of the Cat 328 D excavator as observed on 8-12-09. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard include but is not limited to enforcing employees usage of seat belts when operating equipment and to follow Caterpillar the manufacturer's requirement.
