29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)   At the residential construction site located at 3011 Swift St in North Kansas City, Missouri:  Employees engaged in framing activities were exposed to health hazards from dermal, ingestion, and inhalation exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to Residental Sealant and Siliconized Caulk.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:   At the jobsite located at 3011 Swift St., North Kansas City, Missouri- Employees were observed using pneumatic nail guns as well as radial saws to cut wood and were not protecting their eyes by the use of any means of eye protection.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:   At the jobsite located at 3011 Swift St, in North Kansas City, Missouri:  Employees were exposed to fall hazards.  Employees engaged in construction activities were exposed serious injuries, in that a Sky Trak forklift was being used to support an elevated makeshift work platform. The platform was a job made box that was not specifically designed and approved by the manufacturer for this task.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:   At the jobsite located at 3011 Swift St, in North Kansas City, Missouri- Employees were exposed to fall hazards while working on two separate levels, approximately 10 feet and approximately 30 feet above the ground were not protected from falling by the use of  any means of fall protection.

At the jobsite located at 3011 Swift St in North Kansas City, Missouri:  Employees were exposed to a fall hazard.  Employee engaged in construction activities were exposed serious injuries while working from an elevated makeshift work platform that was not firmly secured to the lifting carriage and or forks.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  At the jobsite located at 3011 Swift St., North Kansas City, Missouri- Employees were exposed to shock or electrocution hazards in that the cord to the radial saw had its' outer insulation breached.     Bear Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.403(b)(1), which was contained in OSHA inspection number 1295086, citation number 1, item number 3 and was affirmed as a final order on 6/6/2018, with respect to a workplace located at3805 NE 80th St. Kansas City, Missouri.
