Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by and crushing hazards:
(a) Auto Repair Shop - The employer failed to remove from service (2)
in-ground automotive
lifts in the service area that was leaking hydraulic fluid.  Employee(s)
working under vehicles
elevated by the automotive lifts were exposed to hazards of being crushed
by and struck by
vehicles collapsing from their elevated position.
Among other methods, one feasible and acceptable method to correct the
hazard is to include,
but not limited to the following:
(1) Conform to the American National Standards Institute/Automotive Lift
Institute Standard for
Automotive Lift Safety Requirements for Operation, Inspection, and
Maintenance,
ANSI/ALI
ALOIM-2000, Section 4.5.
Sears Auto Center was previously cited for a violation of this
Occupational Safety and
Health standard or its equivalent standard, Section (5)(a)(1) which was
contained in OSHA
Inspection Numbers 308732874 and 309211258, Citation number 1, Item Number
1,
respectively.  The citations was issued on May 23 2005 and August 9, 2005,
with respect
to the Sears Auto Center located at 9411 N. Greenwood in Niles, IL.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
