Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that, employees
were exposed to the hazard of falling from and/or being struck by mobile
refuse collection truck
being used or struck by another private vehicle traveling the same
roadway: On or about June
30,2008 employees were riding on the back of the refuse collection truck
while
the truck
traveled at speeds up to approximately 35 mph. Feasible and acceptable
abatement method,
among others, to correct this hazard is:
1) Comply with the safety standards in the Environmental Industry
Associations "ANSI
Z245.1 - 1999" for Equipment Technology and Operations for Wastes and
Recyclable
Materials Mobile Wastes and Recyclable Materials Collections,
Transportation, and
Compaction Equipment safety Requirements and
2) Training employees and supervisors  under paragraph 6.1 and
3) Ensure that no employees ride on steps when vehicle is exceeding 10
mph, or when the
distance traveled exceeds 0.2 miles in compliance with paragraph 6.2.5.4
Note: Abatement Certification and supporting documentation is necessary
for this item.
