Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish a place of employment which was free from any recognized hazards
that are causing
or likely to cause death or serious physical harm to employees in that
employees were
exposed to struck-by and crushing hazards:
a)Meyer's Market: Employer failed to require an employee operating a JCB
506C Loadall VIN #SLP508CO4EO587858 to maintained a fastened seat belt
to prevent being ejected from the vehicle while lifting bundles of blocks
and
bricks.
A feasible and acceptable method of abatement to correct this hazard
includes, but are not
limited to, the following:
1)Conform to the requirements of the JCB 506C Operator's Manual page 30
that
states, "If you do not wear your seat belt you could be thrown about
inside the
machine, or thrown out of the machine and crushed.  You must wear a seat
belt when using the machine.  Fasten the seat belt before starting the
engine".
2)Conform to the requirements of ASME/ANSI B56. 1a-1989 Addenda to
ASME/ANSI B56.1-1988 and ASME B56.1-1993 Safety Standard that requires
the use of seat belts and for manufacturers to develop a program to
retrofit
older models.
