Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.At the workplace, the employer did not label the forklift battery extractor/lifter used to remove/install the batteries in electric forklifts with the rated load capacity, thus exposing employees to a struck-by hazard. b.At the workplace, the employer did not label the bag unloader on the K-2 Line used to lift bags of raw material, thus exposing employees to a struck-by hazard. Among other methods, one feasible and acceptable method to correct this hazard is to affix data plates to the forklift battery extractor/lifter and the bag unloader in accordance with ASME Standard B30.20, Section 20-1.2.
