General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to falling and or a crushing hazard: a) Lot 5.17, Block 5.01, Demott Road, Flemington, NJ 08822. Employee was working on and from a jobmade platform attached to the forks of a Lull, 644D-34 Rough Terrain Forklift elevated approximately 32 feet above the ground below. The platform was not approved by the manufacturer of the Lull, was not properly secured to the forks of the Lull and the employee was not provided personal fall protection. A FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE: a) PROVIDE A PERSONNEL PLATFORM APPROVED BY THE MANUFACTURER. b) PROVIDE FALL PROTECTION SYSTEM TO PROTECT THE EMPLOYEE WHILE WORKING FROM APPROVED PLATFORM.
