29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: a) West side of house, 4445-47 Central Ave, Ocean City: Employee used the closed Werner Type 1, 6 foot fiberglass step ladder, to access the pump jack scaffold platform from the approximate 2 foot wide 3rd floor over hang; bottom of ladder was resting where the top of overhang met the front wall and leaning on the platform, on or about 07/23/2019. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) West side of house, northeast corner of 45th Street and Central Avenue: An employee without proper fall protection, was working from the approximate 27 foot level on an improperly setup pump jack scaffold platform, on or about 07/23/2019. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary: a) West side of house, 4445-47 Central Avenue: The poles for the pump jack scaffold setup and used by an employee without proper fall protection working from the approximate 27 foot level was only secured with a brace for each aluminum pole on the roof at approximately 38 feet, on or about 07/23/2019; b) North side of house, 4445-47 Central Avenue: The four poles for the pump jack scaffold setup and used by employees to install cedar siding was only secured with a brace for each aluminum pole on the roof at approximately 35 feet, on or about 07/23/2019. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
