North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to thrown against, struck-by, and crushed-by Roll Over Protection System (ROPS) hazards during tip-over: a)facility, throughout - where an employee was observed operating a Kalmar AC Forklift (truck # 6418, SN 101975A, model C 100BXC GPS LP) without wearing the installed seat belt during operation. ABATEMENT NOTE: One feasible abatement, among others, would be to re-train employees in proper use of seat belts and to require operators to wear the seat belt during forklift operation. (Reference: ASME B56-1-2004 Safety Standard for Low Lift and High Lift Trucks, Paragraph 5.3.19: An active operator protection device or system, when provided, shall be used.)

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)facility, wet sections of lines 1, 2, and 3 - where employees were allowed to use a Frame C Spacemaster II hoist (serial number 1678529301) to lift coils of aluminum weighing up to 7000 pounds and the self-locking safety latch on the hook was damaged and would not close. ABATEMENT NOTE: One feasible abatement, among others, would be to replace the broken safety latch with one that was fully operational. (Reference: ASME B30.10-2005: Hooks, Section10-1.3(j) Self-locking hooks shall be locked during use.) (Reference: Frame C Spacemaster II: Installation, Operation and Maintenance Instructions, page 4-4: Safety latches should be replaced if bent or broken to the extent that they no longer provide proper closure of throat opening of hook.)g
