Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to toxic air contaminants: At this location, in the wash bays, the employer does not implement engineering controls such as continuous ventilation for employees involved in tank cleaning operations. This violation was observed on or about the following dates as employees were removing Hexamethylene Diisocyanate (HDI), without engineering controls to reduce atmospheric contaminants, from DANA tanker # 1602 in wash bay # 3; a.August 27th, 2009 an employee removing HDI from the inside of a tanker was exposed to 1.2254 mg/m3 of HDI. This exposure is 8.75 times the NIOSH Ceiling of 0.14 mg/m3. b.August 27th, 2009 an employee removing HDI from the inside of a tanker was exposed to 0.3714 mg/m3 of HDI. This exposure is 2.65 times the NIOSH Ceiling of 0.14 mg/m3. c.August 24th, 2009 an employee removing HDI from the inside of a tanker was exposed to 0.0.6529 mg/m3 of HDI. This exposure is 4.66 times the NIOSH Ceiling of 0.14 mg/m3. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date of this citation, the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure engineering controls are implemented to reduce employee exposure to airborne contaminants during entry into confined spaces containing toxic atmospheres.
