Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck by falling steel storage racks and/or components of the steel storage racks, including any materials stored on the racks: A) Warehouse Storage Areas - On April 9, 2009, and at times prior thereto, throughout the warehouse areas, the employer failed to ensure that steel storage rack components were maintained properly and protected against damage. AMONG OTHER METHODS, SOME FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THIS HAZARD ARE: (1) Repair or replace the damaged storage rack components per manufacturer specifications. (2) Develop a maintenance program designed to recognize weaknesses in the rack system to prevent a structural collapse. (3) Follow the guidelines established in the American National Standards Institute (ANSI) MH 16.1-2008 and MH 16.2-1984. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM
