North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck against/struck by: a)in the "chipper plant", a "Bobcat 236" skid steer loader was used to remove materials from the back of a truck bed/trailer and the wheels of the truck were not chocked and the emergency brake was not engaged. Among other methods, one feasible and acceptable method to abate this hazard is to chock the wheels and set the emergency brake on the truck before entering with any type of mobile equipment.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)in the yard, railway area, the ground man, directing the operator of the "Mobile Track", does not have a means of verbal or other communication when visual contact is impeded, and rail cars are still moving. Among other methods, one feasible and acceptable method to abate this hazard is to provide the ground man a two way radio.
