North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish conditions of employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious injury or serious physical harm to employees in that employees were exposed to fall hazards: a)within the facility, employees are allowed to ride on a pallet or a parts container attached to the forks of the Toyota Fork Truck, Model Number 42-6FGCU, to access the pulley on the Eriez Metal Sorter/Conveyor, approximately 7'6" above lower levels. b)within the facility, employees are allowed to ride in the bucket of a Caterpillar Wheel Loader, Model Number 924G, to access the pulley on the Eriez Metal Sorter/Conveyor, approximately 7'6" above lower levels. ABATEMENT NOTE: Among other methods, one feasible and useful method to abate this hazard is not to allow employees to ride moving equipment in an unapproved manner. c)within the facility, employees are allowed to stand on the top of the 8' high, approximately 1' wide, wall to access the pulley on the Eriez Metal Sorter/Conveyor. ABATEMENT NOTE: Among other methods, one feasible and useful method to abate this hazard is to not allow employees to stand on the wall to access the pulley.
