Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falling from ladders due to unsafe
access:
a) On or about April 30, 2009 and at times prior, a fiberglass extension
ladder was not
extended beyond the upper level and had no grasping device available for
employees stepping
to and from the ladder.
b) On or about April 30, 2009 and at times prior, a fiberglass extension
ladder was used with
a missing top cap exposing employees to sharp edges.
Abatement Note:  Abatement certification and documentation is required for
this item
(see enclosed "Sample Abatement-Certification Letter").
Abatement Note: Among other methods, one feasible method of abatement is
to:
a) Ensure that ladders are used per American National Standard Institute
(ANSI)
A14.5-2000, Ladders-Portable Reinforced Plastic Ladders, Section 9.3.10.
b) Ensure ladders are equipped with top/end caps per ANSI A14.5-2000,
Ladders-
Portable Reinforced Plastic Ladders, Section 6.2.10.

a) On or about April 30, 2009 and at times prior, employee utilized a wood
step ladder to
gain access to the top of a parapet wall that measured approximately 8
feet in height.  While
the ladder was in use by employee, it was closed and leaning against the
wall, exposing
employee to fall hazards.
