Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause
death or serious
physical harm to employees in that employees were exposed to fire and dust
explosion hazards
from dust collection systems that were not located and/or properly
designed to minimize damage
that would occur in the event of a dust explosion inside the machinery:
On or about 01/30/09, in the extrusion and milling areas, bag houses were
located inside the
manufacturing area without explosion suppression systems and/or
deflagration venting to a safe
outside location.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method of
abatement
would be to vent bag-house deflagration panels through the roof to the
outside. See the National
Fire Protection Association standard, NFPA 654 (2006), "Standard For The
Prevention of Fire
And Dust Explosions From The Manufacturing, Processing, And Handling Of
Combustible
Particulate Solids".
PLEASE NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS
REQUIRED FOR THIS VIOLATION.

as methods were not utilized to control combustible dust generated by the
manufacture of copy
machine toners:
On or about 01/30/09;
(a)Exhaust ventilation systems were not installed in the extrusion, post
blending, and
virgin blending areas to control dust clouds escaping from blending and
other
processing machinery, and
(b)Dry sweeping is used to clean floors.
ABATEMENT NOTE: Among other methods, feasible and acceptable methods of
abatement
would be to install ventilation systems with exhaust hoods over blending
and other offending
machinery and to clean the floors by vacuum. See the National Fire
Protection Association
standard, NFPA 654 (2006), "Standard For The Prevention of Fire And Dust
Explosions From
The Manufacturing, Processing, And Handling Of Combustible Particulate
Solids".
