Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from employees not being restrained in a forklift in case of a tipping and/or rollover: a)Right side of Pacific Hub Enterprise parking lot: An employee was observed operating the NISSAN (Model Variation #: PHO2A25V) without wearing a seat belt. ABATEMENT NOTE: AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELT AS REFERENCED IN ITSDF B56.1-2005 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" OR FOLLOW THE OPERATOR MANUAL UNDER USE OF SEATBELT.
