Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a/Ready Pac/Florence NJ Site/Trailer yard: An Ottawa 4X2 yard truck was operated with external riders which is prohibited by the manufacturer. Observed on or about 10/17/08 One feasible and acceptable method of abatement would be to incorporate this into the existing training plan and standard operating procedure. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
