Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that an employee
was exposed to a tipping hazard:
(a)  An employee using a JLG 2030 scissors lift to change a light bulb in
a grassy area
off the paved lot suffered a fatal head injury when the lift tipped over,
on or about
10/15/08.
ABATEMENT CERTIFICATION REQUIRED
Among other methods of abatement, one feasible and acceptable method to
correct this hazard
is to ensure:
(A) Employees follow safe work practices as recommended in the JLG
Operation and Safety
Manual: "Do not elevate platform or drive with platform elevated while on
or
near a sloping,
uneven or soft surface. Ensure machine is positioned on a firm, level and
uniformly supported
surface before elevating platform or driving with the platform in the
elevated position."
(B) Employees follow the training requirements of ANSI/SIA standard
A92.6-1999, 8.5,  which
requires: "Only personnel who have received general instruction regarding
the inspection,
application and operation of aerial platform, including recognition and
avoidance of hazards
associated with their operation, shall operate an aerial platform.  Such
items shall include, but
not necessarily be limited to," the items listed under section 8.5.1.
