Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a crushing/amputation hazard from unintended
activation:
a) Press Brake #148: The foot treadle on the press brake was not guarded on
or about December 10, 2008.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to guard the foot treadle.
b) All Press Brakes: The employer has implemented a "safe distance"
guarding
program, however not all employees were aware of the safe distance, and
their
hands were not kept at least 4 inches from the point of operation during
press
brake operations on or about December 10, 2008.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to comply with ANSI B11.3-2002, Safety Requirements for Power Press
Brakes,
Paragraph 8.7, which includes criteria for an acceptable safe distance
safeguarding program.
