OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1070: The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were operating press brakes with an unprotected foot pedal actuator: a) Press Brake Dept.: Employees were operating the Chicago Dreis & Krump model 4510-D, (s/n P8461) press brake with an unprotected foot pedal actuator, exposing employees to the unexpected machine operation and caught-in/by hazards, as observed on or about September 25, 2017. b) Press Brake Dept.: Employees were operating the Chicago Dreis & Krump model 410-D, (s/n P8363) press brake with an unprotected foot pedal actuator, exposing employees to the unexpected machine operation and caught-in/by, as observed on or about September 25, 2017. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Throughout Facility: The employer did not establish an energy control program consisting of procedures, employee training, and periodic inspections, for those employees, including machine operators, maintenance personnel, and other personnel, who were working in proximity or performing service and maintenance on machines with multiple energy sources, including but not limited to press brakes, to protect the employees from the unexpected energization, startup or release of stored energy, exposing employees to crushing, electrical, thermal, and amputation hazards, on or about September 25, 2017. ABATEMENT CERTIFICATION REQUIRED FOR THIS VIOLATION.
