Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: a) Lick Creek Road & Rt. 87/Cherry Mill, PA: Cement forms were lifted without the use of lifting brackets, supplied by the manufacturer for that purpose. The form slipped off a hook, striking the employee in the head and fracturing his skull, on or about 08/31/09. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO ABATE THIS HAZARD IS: to follow the operating practices set forth in the ANSI/ASME B30.9-1984 safety standards for cableways, cranes, derricks, hoists, hooks, jacks and slings, Section 9-1.9(e) Operating Practices, page 18 which states: The sling shall be hitched or rigged in a manner providing control of the load, OR follow the manufacturer's recommendations by using "lifting brackets" supplied by the manufacturer at the time of purchase of the forms. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
