Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of of being crushed from falling off
or being ejected from
frontend loader/backhoes where the operators are not wearing seat belts.
a.  On or about July 7, 2008, a frontend loader/backhoe operator engaged
in excavating
and moving dirt activities was exposed to crushing hazards from falling
off or being
ejected from the frontend loader/backhoe where the operator was not
wearing his seat
belt.
One feasible and acceptable abatement method, among others, to correct
this hazard
would be to enforce the manufacture's procedures for seat belts use and
the
company's
safety rules requiring employees to use the provided restraint system
(Seat Belts) at all
times while operating materials handling equipment.
