Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards. The bay doors of the facility limit the height that the drivers can extend/raise the truck bed of the Volvo and International recycle trucks consequently the contents of the truck are not completely discharged. Drivers are required to manually remove material remaining in the truck while working under the raised tailgate and therefore are exposed to a crushing hazard should there be a failure in the tailgate hydraulic system. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to extend the height of the facility truck bay doors to allow the bed of the recycle trucks to fully extend and allow for the complete unassisted evacuation of the contents of the truck bed.
