Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Located at Ecotope, Inc., Providence, RI: On or about 11/01/2011 the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees the operators of the Volvo recycle truck were required enter the truck bed to perform two different tasks. One task requires the operator enter the truck bed to manually operate the Maximizer due to the Maximizer control located in the cab of the vehicle was not operational and the other task involves the operator entering the truck bed to clear the tracks of the Maximizer of debris. The process of entering the truck bed requires the employee to pass underneath the raised tailgate and therefore exposes the employee to crushing injuries by the tailgate in the event of a failure in the hydraulic system. ABATEMENT NOTE: Among other methods, two feasible and acceptable methods to correct this hazard would be to one, repair the cab's operator control for the Maximizer and two, engineer and construct a rake with an extended handle that would allow the employee to clear the tracks while standing outside the tailgate's swing radius. "ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM" The Ecotope, Inc. (formerly Cleanscape, Inc.) was previously cited for a violation of this occupational safety and health standard which is contained was contained in OSHA inspection number 312344633, citation number 1, item number 1 and was affirmed as a final order on 08/03/2010, with respect to a workplace located at 150 Colfax Street, Providence, RI.
