Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of struck-by and crushed-by unsecured loads. At the jobsite: On or about September 5, 2008, and at times prior thereto, employees were not protected from the hazard of being struck-by an unsecured load of pipe being unloaded from a trailer. The employer did not ensure that there was an established safe work practice and/or use of equipment in place to protect emplyees from being struck by falling material while loading/unloading pipe from trailer. Among other methods, feasible abatement options include: 1. Provide means to prevent the pipe from rolling off the trailer like side boards or stakes. 2. Where necessary, have additional personnel and equipment involved to stabilize the load while removing pipe. 3. Develp and implement work rule to stand clear of unsecured loads. IN THE ALTERNATIVE: 29 CFR 1910.176(b): Storage of material shall not create a hazard. Cylindrical materials were not stacked and blocked so as to prevent spreading or tilting: On or about September 5, 2008, and at times prior thereto, employees were exposed to the hazard of having pipe roll onto them; the pipe was not secured to prevent sliding or falling after the winch was opened and the straps released.
