Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazard that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to falling approximately seven feet from the top step of a step ladder: At the Galleria Parking Garage, East side of Garage: On or about February 10, 2009, employee engaged in repair of light fixture, did not follow recommendations of the manufacturer. The employee was standing on the top rung of the 8 foot step ladder. Employee was exposed to the hazard of falls. Feasible methods to correct this hazard include: Use the ladder as intended by the manufacturer; Use a ladder of greater length; Comply with recognized standards regarding safe use of portable ladders.
