Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from caught-in-between or struck-by hazards associated with equipment operation: At the worksite: On or about July 9, 2009, and at times prior thereto, the employer required an employee to operate a rough terrain type forklift around other employees without the audible backup alarm working. Employees were exposed to the type of hazards associated with caught-in-between and struck-by. Among other methods, feasible and acceptable methods of abatement include maintaining the equipment with the original alarms functioning as intended and complying with Association of Equipment Manufactures (AEM) Safety Manual for rough terrain forklifts.
