Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm:
In that employees were exposed to the hazard of falling from heights of
greater than four (4) feet
when elevated by the forklift in the personnel basket to perform tasks on
the pressure vessels.
For the employees working on pressure vessels on or about July 28th, 2009.
The employer did
not ensure employees were working from a personnel platform with a guard
rail and means for
attaching the platform securely to the mast.
The hazard is recognized by the manufacturers web site which refers to and
supplies a copy of
ANSI B56.1 Which according to the manufacturer is also referenced in the
operators manual
supplied with the equipment.
A proposed method of abatement may be to provide a personnel platform
designed to the
specification of the American National Standards Institute (ANSI) B56.1 -
4.17.3(a) which
references ANSI B56.1 - 7.37.3.ces
