Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the hazard(s) of being crushed, trapped,
or thrown while operating riding mowers around hazardous terrain,
having drop-offs which could result in roll-overs or flipping:(a)
in that the employer did not ensure employees, operating riding
mowers (such as the John Deer 2500), were using the provided seat
restraints for the mowers equipped with roll-over protection(ROP)
devices.
Among other methods, one feasible and acceptable abatement method
to address this hazard is to: a) develop and implement an effective
training program for the mower operators which incorporates, at a
minimum, that operators read the operator's manual and are trained
in the safe operating practices for the mowers, and in recognition
of potentially hazardous operating conditions before allowing
operator to use equipment. (Ref. ANSI B71.4 - 1999 Safety
Specifications for commercial turf care equipment).
Note: Abatement certification and supporting documentation are
required for this item.
