Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the hazard(s) of being thrown, crushed,
or trapped, while operating the chip dozers on top of chip piles
which have drop-offs which could result in equipment rolling to its
side or rolling over: (a) in that the employer did not ensure
employees operating the D8N/D8K Caterpillars, were using the
provided seat restraints for the chip dozers equipped with the
roll-over protection (ROP) devices.
Among other methods, one feasible and acceptable abatement method
to address this hazard is to: a) develop and implement an effective
training program for the chip dozer operators which incorporates,
at a minimum, that operators read the operator's manual and are
trained in the safe operating practices for the chip dozers and in
recognition of potentially hazardous operating conditions before
allowing operator's to use equipment.
Note: Abatement certification and supporting documentation are
required for this item.
