General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from a work platform placed on the forks of a powered industrial truck: a) On or about August 15, 2008, a home-made platform that did not have a mid-rail at the entrance opening and did not have steps that were uniform and with clearance in back of them so employees feet could safely fit on the steps/rungs was used to lift a maintenance employee to a height at or above 10 feet to check photo sensors above the receiving dock. In addition, there was no device used to secure the platform to the mast in event the mast was inadvertently tilted forward. One feasible and useful method to correct these hazards is to use a safety platform that has standard guardrailing on all sides, with steps/rungs that have at least 7 inches clearance behind them, and a means of securing the platform to the mast.
