North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to: Crushed by collapsing  lifts [ Ref
ANSI/ALI ALOIM -1994.4.4.4The employer
shall take appropriate steps to follow the inspection procedure of the
manufacturer to include having the
operator inspect features on a daily basis to include (4) The proper
operation of locking devices, (6) excessive
wear of components,(8) Evidence of hydraulic leaks.]
a)Bay #1 - the "Rotary" lift was not receiving its daily inspection that
allowed the damaged
upper limit switch to remain defective.
b)Bay #1,3,4,5,6,8- the "Rotary" and   Magnum lifts were not receiving
their daily inspection
that allowed the automatic safety latches to remain out of adjustment and
not deploy.
c)Bay #6 - the "Magnum" lift was not receiving its daily inspection and
the hydraulic cylinder
was left in service with an oil leak.
Abatement note: One means of abatement would be to acquire the daily and
weekly inspection check
sheets for the equipment through the dealer and employ and enforce a
documented inspection program
to ensure that defected equipment is quickly identified.

employees were exposed to: Crushed by unsecured vehicles [ Ref ANSI/ALI
ALOIM -1994.4.5 If there are any
conditions reported as described in 4.4.4 (4-10) (6) excessive wear of
components, the lift shall not be used
until the appropriate repairs have been made by a qualified automotive
lift
personnel. In order to ensure the lift
id not used until repairs are made the lift shall be locked or tagged out ]
a)Bay #4,6 - the  Magnum lifts were reported to management as having a
worn shim that
allowed the vehicles to be lifted "out of square" and the lifts were to
remain in service until
their replacement
Abatement note: One means of abatement would be to establish a "tag system
" to be applied at  the
power control switch and on the lift controls informing employees that the
lift is "Out of Service" with
only management having the authority to have the tags removed after the
repairs are confirmed.
